Software License & Usage Terms

1. Intellectual Property Rights

OcuTrap retains all intellectual property rights in its services and the OcuTrap trap, including but not limited to any firmware or software embedded in the equipment ("OcuTrap Trap") or used to provide the services ("Software"). This agreement does not transfer any intellectual property rights to you or any third party.

2. Grant of License

OcuTrap hereby grants you a non-exclusive, non-transferable license to use the Software in object code form only (without making any modifications thereto) ("License"). This License is granted solely for the purpose of using the OcuTrap Trap in connection with the services provided by OcuTrap, and is subject to the conditions and limitations set forth in this License.

3. Restrictions on Use

You agree not to reverse compile, disassemble, reverse engineer, or otherwise attempt to derive the source code from the binary code of the Software. You shall not take any action nor allow anyone else to take any action that violates this restriction. Further, you may not modify, distribute, sell, or lease any part of our Software, nor may you use our Software to host any commercial or unauthorized activities.

4. Open Source Components

Certain components of the Software ("Open Source Components") may be covered by open source software licenses ("Open Source Licenses"). Open Source Licenses are any software licenses approved as open source licenses by the Open Source Initiative or any substantially similar licenses.

5. Precedence of Open Source Licenses

To the extent required by the licenses covering third-party Open Source Components, the terms of such Open Source Licenses will apply to the Open Source Components instead of the terms of this License.

6. No Warranty

THE SOFTWARE IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. IN NO EVENT SHALL OCUTRAP BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

7. Termination

This License is effective until terminated. Your rights under this License will terminate automatically without notice from OcuTrap if you fail to comply with any term(s) of this License. Upon termination of this License, you shall cease all use of the Software and destroy all copies of the Software in your possession or control.
